Buffy should get adult sentence: Crown

A maximum of seven years under youth sentencing is not nearly enough to rehabilitate a teenage girl or hold her accountable for her part in the murder of Nina Courtepatte, a Crown prosecutor told court Thursday.

Prosecutor John Watson argued that Buffy 1-7 dvd, the nickname of a girl who was 16 at the time of her crimes, should be sentenced as an adult for her role in the violent rape and murder of 13-year-old Nina.

Though she is now 20, her identity is protected by the Youth Criminal Justice Act.

She was convicted in July 2008 of second-degree murder and aggravated sexual assault after a judge found she stabbed Nina's neck and helped hold her down while she was raped by two others in the middle of a golf course in 2004.

Under the Youth Criminal Justice Act, Buffy 1-7 dvd would receive a maximum of seven years if sentenced as a youth.

“Is a youth sentence long enough to hold (her) accountable for her actions?” Watson asked the court. “Can she be treated or rehabilitated with the maximum of the Youth Criminal Justice Act? If not, then an adult sentence must be imposed.”

Court has already heard of the lifetime of abuse, neglect and homelessness that have dominated Buffy’s life, but Watson argued that does not disqualify her from making her own right choices.

“There is no form of even remote justification for this crime,” Watson said. “I submit this was a murder for the thrill of it. No other explanation comes to mind.”

During the arguments, Buffy 1-7 dvd slowly rocked back and forth but otherwise showed no reaction.

Buffy is the last of the five accused to reach trial in relation to Courtepatte’s death.

Defence lawyer Peter Royal argued that the teen should be sentenced as a youth because she did not directly contribute to Nina’s death or coerce her from West Edmonton Mall to the golf course.

The one stab wound Buffy 1-7 dvd box set did inflict was deep, but not life-threatening, Royal said.

Buffy has now been in custody at the Calgary Young Offender Centre for four years, roughly a fifth of her life.

During that time, Royal stated, the girl is “viewed as a model prisoner.” In custody, she has completed three-quarters of the classes required for a high school diploma and acts as an ambassador for visitors to the school program.

Royal argued that his client is less blameworthy than the other attackers that night who raped Courtepatte and bludgeoned her with a sledgehammer.

“Her involvement in this crime was lesser,” he said. “A youth sentence would be entirely appropriate.”

In previous testimony, forensic psychiatrist Vinesh Gupta classified Buffy 1-7 dvd box set as a moderate-to-high risk to reoffend. The teen is far more likely to see herself as a victim than show remorse for her actions, he said.
